‘Predictit’ Plaintiffs Make Case to Higher Court
Plaintiffs argue that District Court inaction causes irreparable harm in appeal to higher court

WASHINGTON - January 3, 2023 - (Newswire.com)

More than a dozen PredictIt traders and educators, and PredictIt service provider Aristotle, who are suing the Commodity Futures Trading Commission (CFTC) in federal court, have filed a Motion for an Injunction Pending Appeal in the Fifth Circuit. In the filing, they argue that a district court has delayed action to the point where relief would otherwise come too late to protect the PredictIt Market which has functioned for more than eight years. The Motion asks the Court to rule by Jan. 19, 2023.

Following several months of inaction and given the time-sensitive nature of this issue, plaintiffs filed a motion on Dec. 23, 2022, to move their request for a Preliminary Injunction from the United States District Court for the Western District of Texas to the United States Court of Appeals for the Fifth Circuit. 

This action asks the Fifth Circuit to enter an interim order preventing shut down of the PredictIt market while the Court considers the appeal. The filing also presents plaintiffs' reasoning for the motion and states that PredictIt and its traders have already suffered irreparable harm in the form of distorted pricing and compliance costs as a result of the CFTC's order to shut down on the arbitrary date of Feb. 15, 2023. 

"Given that the CFTC gave PredictIt an arbitrary deadline that is quickly approaching, and the District Court's focus on a venue change argument ahead of the substantive issues, we are pursuing every possible avenue to get relief and answers for the plaintiffs and the broader PredictIt user base," said David Mason, Aristotle General Counsel and former Federal Election Commission (FEC) Chairman.

Aristotle is the contract service provider for the PredictIt Market, which has operated under No-Action Relief CFTC 14-130 since 2014.

What is the organization's sabbatical policy?

Before making decisions about sabbaticals, employees will want to find out what their company's stance on long breaks is. Some companies and institutions offer a sabbatical after a certain number of years and are usually transparent about the leave policy. Employees who are unsure may want to check with human resources and browse the employee handbook or leave policy document, especially any information pertaining to "career breaks," "sabbaticals" or "long-term leave."

Employees will also want to find out whether their company offers fully or partially paid sabbaticals. Depending on the answer, this can mean significantly altered financial circumstances. 

Does the team have a replacement on hand?

Before talking to their manager about taking time off, employees should do a quick evaluation of their team and tasks. Is there someone on the team who will be able to take over the workload? Will a replacement need to be hired? Will a temporary departure leave the team short-staffed? These are the factors management will need to contend with before approving a sabbatical. Over 36 million Americans don't have a computer at home, which limits their access to education, healthcare, and other resources. Digitunity, a national nonprofit dedicated to advancing digital equity through device ownership, has launched a YouTube series, "Pressing On: In Pursuit of Digital Equity", that spotlights those affected by the digital divide and explores possible solutions.

Digitunity connects donations of computers with people who need them through a nationwide network of community partners. The organization's research and nearly four decades of experience show that the digital divide disproportionately affects lower-income individuals, older adults, rural communities, veterans, and military families. 

"We're presenting stories from across America of students trying to succeed in school, workers training for better jobs, patients connecting with their doctors, and the organizations working to get these individuals what they need," said Scot Henley, Digitunity's executive director. "Digitunity's mission is to narrow the digital divide." 

In collaboration with its cornerstone partners, including Alliant Credit Union, AVID Products, Onepak, and CompTIA, Digitunity plans to release a new "Pressing On" video on its YouTube channel every Sunday evening through early 2023. In the opening video, Dennis Devine, president and CEO of Alliant Credit Union, outlines the "Corporate Benefits of Partnering with Digitunity."

Alliant is a not-for-profit financial cooperative and one of the nation's largest credit unions. It was the first partner to sign Digitunity's Corporate Pledge to End the Digital Divide. Devine notes that, this past year, more bank branches have closed in the U.S. than ever in the history of banking. This is why it is critical for everyone to have digital access to financial information.
